Safe Nurse Staffing Laws in State Legislatures

ANA works in coordination with Constituent Member (State) Associations (CMAs) to implement a Nationwide State Legislative Agenda that focuses on issues important to nurses, including the development and implementation of valid and reliable nurse staffing systems.

To date, 15 states (CA, CT, IL, ME*, MN, NV, NJ, NY, NC, OH, OR, RI, TX, VT, WA) plus the District of Columbia* have enacted legislation and/or adopted regulations addressing nurse staffing. States have utilized varying approaches: mandated ratios; hospital staffing committee responsible for creating staffing plans, and disclosure; or a combination of the three.

Twelve states have staffing laws. North Carolina decided in 2009 to study mandatory overtime as a staffing tool.

*Delaware and the District of Columbia changed legislation from its original intent to remove mandatory staffing provisions.
